			<content:encoded><![CDATA[<p>A federal judge ruled Tuesday that an overtime lawsuit filed against Costco Wholesale Corp. could proceed as a state class action in California.</p>
<p>The lawsuit was filed in May 2009 in California Superior Court and removed to federal court by the defendants. The lawsuit alleges that the Washington-based membership warehouse chain locked employees in the store at the end of their shift until manages finished chores such as emptying cash registers and removing jewelry from display cases.</p>
<p>The plaintiffs claim the company did not pay its employees for lock-in time, a violation of California wage laws and federal statute. The plaintiffs say the lock-in periods lasted between 10 and 30 minutes.</p>
<p>The judge&#8217;s ruling Tuesday allows hourly employees who worked at Costco between April 8, 2007 and October 1, 2009 a chance to join the lawsuit and give depositions about their experiences.</p>
<p>Attorney for the plaintiffs, David Sanford, explained the lawsuit saying &#8220;Costco managers do a lot of administrative duties at the end of the day. The rationale for locking the workers in while the managers finish up administrative duties is to secure the building and keep people safe. That is a fine justification, but if you do it, you have to pay the workers.&#8221;</p>

			<content:encoded><![CDATA[<p>A class action overtime lawsuit has been filed against the state of Vermont.</p>
<p>According to court documents, a court-approved notice will be sent to state workers, over the next 10 days,inviting them to join a collection action lawsuit against the state for allegedly fialing to fully compensate employees for overtime. The deadline for filing a claim is March 30.</p>
<p>The lawsuit claims that Vermont violated the Fair Labor Standards Act when it paid certain workers &#8220;straight time&#8221; instead of time and a half for work performed in excess of a 40-hour work week. The plaintiffs are seeking back pay, liquidated damages, interest, and attorneys fees.</p>
<p>Commissioner-designee of the Department of Human Resources, Kate Duffy, said Tuesday the state would &#8220;vigorously&#8221; fight the lawsuit. &#8220;To my knowledge there has not been a finding that a particular plaintiff is entitled to overtime,&#8221; Duffy said. &#8220;Certainly there has been no assertion that there&#8217;s been a widespread violation throughout the state government.&#8221;</p>

			<content:encoded><![CDATA[<p>An overtime collection lawsuit has been filed in California against poultry producer Foster Farms and a staffing agency.</p>
<p>The lawsuit was filed october 19 in Merced County Superior Court by nine people, some who worked for Foster Farms and some former employees of Central California Staffing Services in Atwater. The lawsuit claims that the plaintiffs commonly worked 10 or more hours a day and routinely worked five to seven days a week.</p>
<p>The plaintiffs contend that Foster Farms and Central California Staffing did not properly track workers&#8217; hours and failed to compensate them for additional time worked. The former employees say they were regularly forced to skip meals and rest periods, which are required by law.</p>
<p>Foster Farms and the staffing company said they comply with all relevant state laws.</p>

			<content:encoded><![CDATA[<p>Three paramedics in Texas have filed an overtime collection lawsuit against Williamson County.</p>
<p>According to court documents, three employees of Williamson County Emergency Medical Services &#8211; Heather Clark, David Claxton, and David M. Compton &#8211; claim they regularly worked over 40 hours a week without receiving overtime pay. The lawsuit claims the county violated the Fair Labor Standards Act by not paying the overtime rate of one and a half times regular pay.</p>
<p>County spokeswoman Connie Watson, denies the allegations. &#8220;The county has looked at the issue strongly and feels that it has complied with the Fair Labor Standards Act,&#8221; Watson said.</p>
<p>The class action filing invites any of Williamson County EMS&#8217; 112 paramedics to join the lawsuit.</p>

<p>According to court documents, former pharmaceutical representative Jeffrey Bethune file a lawsuit claiming the drug manufacturer illegally denied him compensation for overtime hours. The lawsuit contends that Bethune would regularly work over 40 hours a week but received an annual salary without overtime pay. The class action lawsuit was filed on behalf of Bethune and all other pharmaceutical representatives who worked for BMS during the last three years.</p>
<p>The lawsuit claims BMS was in violation of the Fair Labor Standards Act, which requires employees to be paid time-and-a-half when they work more than 40 hours a week. Attorney Charles Joseph, who is representing Bethune, says United States Department of Labor has filed friend of the court briefs supporting overtime compensation for pharmaceutical representatives working in excess of 40 hours a week. &#8220;The US Department of Labor recognizes that pharmaceutical reps are not exempt from overtime pay,&#8221; Joseph said.</p>

			<content:encoded><![CDATA[<p>Several Dollar Tree employees in southern Florida filed an overtime lawsuit against the company Sunday.</p>
<p>According to court documents, the lawsuit claims employees were frequently asked to make runs to the bank on company business after hours and were routinely required to work through their lunch hour without proper compensation. The lawsuit contends Dollar Tree retailers are in violation of the Fair Labor Standards Act, including pay below the state&#8217;s minimum wage of $7.25 per hour, and docking pay for employees who work through lunch.</p>
<p>Lawyers for the plaintiffs say the company has been the subject of wage theft lawsuits in the past. &#8220;[Dollar Tree] should have implemented appropriate pay practices company-wide,&#8221; said one attorney.</p>
<p>Timothy Reid, spokesman for Dollar Tree Inc., said he could not talk about the lawsuit. &#8220;We don&#8217;t comment on pending litigation,&#8221; Reid said.</p>

			<content:encoded><![CDATA[<p>A former Los Angeles police officer has been awarded nearly $4 million, after a jury found he was fired in retaliation for his testimony in an overtime collection lawsuit against the department.</p>
<p>According to Los Angeles Superior Court documents, 18-year Los Angeles Police Department officer Richard Romney was awarded the money Tuesday in a lawsuit stemming from unpaid overtime disputes. The jury found that Romney was unjustly fired in 2009 by then Chief William Bratton.</p>
<p>In 2008, Romney testified in a federal overtime collection lawsuit brought by another police officer against the department. In that case, Romney told the court that he rarely took a lunch break because of constant patrol calls. He also testified that he did not seek overtime payment because of unwritten department rules.</p>
<p>Bratton issued a memo in 2005 that the department&#8217;s unwritten overtime rules be strictly enforced.</p>

<p>Chattanooga Police Lt. Corliss Cooper filed a lawsuit in Federal Court Tuesday. He is asking that it be considered a class action complaint. The lawsuit contends that the Chattanooga Police Department has failed to pay proper overtime, at a rate of time and a half. The suit also alleges proper records of overtime hours worked are not being kept by the department.</p>
<p>The lawsuit is brought on behalf of &#8220;all police department members who are or have been employed by the Chattanooga Polcie Department in any rank as non-exempt FLSA personnel who worked overtime on and after July 20,2010, without receiving compensation for each hour worked, including overtime compensation.&#8221;</p>
<p>Cooper&#8217;s attorney, Christopher D. Markel, said he hopes other police officers will join the lawsuit. &#8220;We wish to draw the attention of the community to a decision recently made by the city of Chattanooga in cutting out overtime to supervisors,&#8221; Markel said. &#8220;During the month of July, the city made the decision to cancel overtime benefits for those officers in the police department holding the rank of lieutenant and above.&#8221;</p>

			<content:encoded><![CDATA[<p>The Washington State Nurses Association has filed overtime lawsuits against four hospitals for failing to provide nurses with adequate rest and meal breaks.</p>
<p>The lawsuit filed against Good Samaritan Hospital alleges the facility does not pay the required wages to registered nurses when a missed rest break pushes a nurse into overtime hours, a violation of the Minimum Wage Act. The lawsuit seeks back pay owed to the nurses as well as a commitment to improve Good Samaritan&#8217;s record keeping practices for missed rest breaks.</p>
<p>The lawsuits filed against Tacoma General Hospital and Evergreen Hospital Medical Center contend the hospitals does not pay nurses the required wages for missed rest breaks.</p>
<p>The fourth lawsuit, filed against Holy Family Hospital, alleges the hospital fails to keep adequate records of missed rest breaks, thereby violating a State Supreme Court decision requiring employers to treat missed rest breaks as time worked.</p>
<p>The class-action lawsuits include more than 16,000 registered nurses in the state of Washington.</p>
