Should I be getting paid for on-call time?

Under the FLSA, if an employee is required to be at or near their workplace during on-call hours, and is unable to use the time for his or her own purposes, then the employee should be compensated. For example, emergency room doctors who are on-call should be compensated for their availability. Similarly, firefighters who must await emergency calls should receive compensation.

If you are working on-call but are not receiving wages, your employer may be violating the FLSA. Contact the wage and overtime lawyers of Tycko & Zavareei LLP at 202-973-0900 to discuss the details of your case, as you may be eligible to receive compensation.
