If I receive a salary, am I automatically excluded from protection under FLSA?

No. Just because you receive a salary (as opposed to hourly pay), does not mean that you are not entitled to overtime or other protections under the Act. Even if you receive a salary, you may be entitled to overtime depending on your actual daily job duties. Many salaried employees are entitled to receive overtime pay when they work over 40 hours a week.
