Does the FLSA apply to employees who work on a commission basis?

Yes. Employees paid on a commission basis may be entitled to overtime. However, there is an exemption for commission salespersons if the salesperson receives more than half of his compensation in the form of commissions, has a regular rate of pay of more than 1.5 times the applicable minimum wage, and is employed by a “retail or service establishment.”
