Wages for Computer-Related Occupations

The Fair Labor Standards Act requires that all employees receive at least minimum wage as compensation and that they be paid at one and a half their normal rate for any overtime work. This act is in place to protect the rights of wage earners and their time, but it can be voided by specific exemptions. One of those exemptions includes workers in computer-related occupations including software and computer engineers, software programmers, computer system analysts, and other related jobs. These jobs are exempted but have specific regulations for the compensation of these employees.

If you feel that your wage and overtime rights have been violated by your employer, you may deserve to be compensated for the wages that have been withheld from you. You need experienced overtime lawyers to help you fight for your hard earned wages. Please contact the dedicated overtime lawyers at Tycko & Zavareei, LLP by calling 202-973-0900.

Which Jobs Apply?

There are specific regulations which determine what types of jobs apply to this exemption as well as specific requirements for how these employees must be compensated. Any position that fits these following requirements must be compensated at a rate of at least $455 per week if the employee is paid a salary and must be compensated at a rate of $27.63 per hour the employee is paid on an hourly basis. Additionally:

  • The employee’s duties may include consulting with users to determine the proper software, hardware, or network requirements
  • Jobs may involve developing and analyzing computer systems or programs
  • Employees may be designing, developing or analyzing computer controls of a machine operating system
  • Exemptions apply to any combination of these types of duties or duties that require an equivalent level of training and computer skill

The job descriptions above must represent the primary role of the employee to apply for the exemption. These types of employment require a great deal of skill and training and deserve to be compensated fairly.
