Which Jobs Apply?
There are specific regulations which determine what types of jobs apply to this exemption as well as specific requirements for how these employees must be compensated. Any position that fits these following requirements must be compensated at a rate of at least $455 per week if the employee is paid a salary and must be compensated at a rate of $27.63 per hour the employee is paid on an hourly basis. Additionally:
- The employee’s duties may include consulting with users to determine the proper software, hardware, or network requirements
- Jobs may involve developing and analyzing computer systems or programs
- Employees may be designing, developing or analyzing computer controls of a machine operating system
- Exemptions apply to any combination of these types of duties or duties that require an equivalent level of training and computer skill
The job descriptions above must represent the primary role of the employee to apply for the exemption. These types of employment require a great deal of skill and training and deserve to be compensated fairly.
