Tip Pools and the Law
The laws set forth by the FLSA pertaining to tip sharing and pooling mandate that:
- No employee should be required to pool more than 15% of his or her tips
- Tip pools should only include employees who are regularly tipped (a worker who earns at least 30 dollars a month in tips, independent of pools and sharing)
- Sharing tips with non-tipped employees (such as food expediters) must be completely voluntary
- All tipped employees must earn minimum wages for their time worked. If an employee fails to earn $7.25 per hour, the employer must compensate them.
