“Blue-Collar” Workers and the FLSA

Certain regulations outlined by Part 541 of the Fair Labor Standards Act (FLSA) exempt specific types of employees whose positions required advanced degrees and levels of education from federal minimum wage requirements and overtime pay requirements as long as their salaried position is above a standardized amount. This exemption is not allowed to be applied to “Blue-collar” employees, even if some of their job description requirements match that of those positions exempted by Part 541.
